OIG Hotline investigators, my stalker has appeared to "recommend" recently that I "explain" any and all hotel stays over the last five years.

First and foremost, I will simply say that my cell phones should make quite clear that my hotel stays were perfectly honorable.  I have preserved all of my cell phones as evidence, and their ownership has been conveyed to the OIG Hotline Investigations Division for forensic examination.

I believe that documentation of all cell phone activity can be retrieved from the device itself, though clearly, that process should be a secure one.

My immediate recollection of meals or stays at hotels over the last five years includes:

• a lunch at the Four Seasons Hotel in East Palo Alto
• several brunches and dinners with friends at the Rosewood Hotel in Menlo Park
• several writing retreats to the Nobu Hotel in Palo Alto and the Fairmont Hotel in San Jose
• one stay at a San Jose hotel called the Hayes Mansion when threats from my stalker xxxxxxx xxxx appeared to convey an imminent risk to my family

It is worth noting that Mr. Michael Morris of TSCM America sat in our living room in Portola Valley on Sunday, September 5, 2021 and recommended to me that I physically destroy all of my old cell phones with a hammer.  When I asked him why, he stated that, otherwise, all information could be retrieved from the device itself.

Anytime someone is recommending the destruction of physical evidence, I become concerned.

My stalker seemed to assert that Mr. Michael Morris is signatory to Infragard, and that the $4000 my husband and I paid him, together with his employee Ivan Vikin, to clear our home of surveillance devices was effectively "thrown away."

I note that TSCM's trademarked slogan is "Protecting America's Privacy."

Indeed.

I have concerns that TSCM might be, in truth, protecting the far right's privacy.  If so, I don't believe that role defends America's interests in any way, shape or form.

I will add to this commentary two other details:

First, my stalker seems to be repeatedly referencing a "blue dress" as it pertains to falsified law enforcement reporting connected to hotel stays.  I regret that I do not understand this reference.  I don't know whether a blue dress was removed from my closet at home -- which could have been perpetrated by a house cleaner, by Ivan Vikin, or by Ruperto Solis, among other workers, all of whom would have had access during contracted jobs in my home.  I'm simply uncertain as to how a "blue dress" pertains to false claims about me.  This is knowledge to which I do not currently have access.

Second, I include below an email I sent to myself for documentation purposes on Tuesday, September 29, 2022.  Please note that certain information has been redacted from this post.  However, for those who have access to my email account, lanemacwilliams@gmail.com, the full content is available  in its original form.

Was this the location I retreated to once when xxxxxxx xxxx threatened to kill both Graham and me during a period when Ken was away?

Perhaps try to verify the date through the credit card company?

I remember being panicked at the thought that Graham was in harms's way when I made a late reservation at what I believe to be the Hayes Mansion in San Jose.  The threats seemed specific and convincing enough that I was in genuine fear for our lives.  At the time, I believed that xxxxxxx xxxx and any accompanying assailants would likely come after me -- and have no motivation to harm Graham if I were not at home.  So, I threw together an overnight bag in about five minutes and drove to what I think may have been the Hayes Mansion.  I was able to stay there overnight uneventfully, without speaking to anyone except the front desk clerks upon checking in and out of the hotel.

For some reason, I remember xxxx xxxxx calling me a few days later to praise me for being level-headed under the threatening circumstances.  I believe he stated he was in an airport somewhere during that call.  I also remember that he stated during that same phone call that I should never contact the police regarding xxxxxxx xxxx's stalking activity, which I thought was highly unusual.  He mentioned repeatedly that xxxxxxx (whom he insisted on referring to as "xxxxx" the xxxxxxxx xxxxxxxxx) "had preyed on a woman like this before," apparently referring to the patient xxxxxxx xxxx had victimized when he worked at the Stanford xxxxxxxx xxxxxxx office in Redwood City, CA.  I had no idea that he was warning me away from extensive corruption in the police department and the FBI.  That was, at the time, too far a leap for me to countenance.

I told Ken all about the threats and the hotel stay, which was undertaken in the interests of our safety.

Does the FBI Disrupt the Attempts of "Targets of Interest" to Pay Their Bills?

 OIG Hotline investigators, an invoice from Tasha Fuels allegedly attached by Paula Baxter routed me to a dead-end link on Instagram.  This is the screenshot of the associated page:

To be clear, I am not accessing Instagram or any other social media platform at this time.

In order to ensure that FBI personnel do not attempt to allege otherwise, I am documenting recent email communications with Tasha Fuels below.

It appears that both Panton Plumbing and Tasha Fuels may be withholding invoices, in a pattern in which plumber Tim Duffany also engaged.  There seems to be an intention on the part of the handlers involved to withhold billing and then follow up by accusing a "target of interest" of non-payment.  

When FBI personnel are able to tamper with email accounts of "targets of interest," disruption of normal communications becomes a fairly simple matter, it would seem.

It is likely that Paula Baxter's email account shows a sent invoice, while mine shows no invoice received.

This type of disruption appears to be typical of attempts on the part of far right segments of the FBI to falsely characterize "targets of interest" as "unreliable," "untrustworthy," or "criminal" in their financial dealings.

Reflections on the Guardians of Civil Liberty

1.  OIG Hotline investigators have a very full plate.

Answer:  I am not apprised of their work at all.  But I see my role as giving them as much information as possible, including appropriate waivers, so that they can decide on their initiatives.

I am attempting to communicate as much detail as I can, because I feel a responsibility toward those whose circumstances, through no fault of their own, have prevented them from obtaining advocacy.

2.  Despite the myriad perils of being wrongfully designated as a "target of interest," you have also had many gifts.

Answer:  I have a wonderful husband.  I am fortunate to have had access to higher education.  I have a savings account.  As a writer, I am able to wield a pen in my own defense and that of others.  I have a faith which is sustaining.  

And I have been fortunate in finding some wonderful people within the federal government who have listened to my concerns.  OIG Hotline investigators, the Honorable Avril Haines of ODNI, and President Biden have all been courageous and determined -- and their presence has been transformative in every way.

Imagine how much more difficult life would be for a law-abiding "target of interest" who was single and working sixty hours per week to pay the rent.  If such a person was defamed as a criminal, as someone who was psychologically unstable or possessing poor character in her or his personal life, what opportunity would she or he have to speak the truth?

There are many whose daily circumstances are sufficiently strained that they can be deprived of their civil liberties and human rights without any opportunity for redress.

3.  You are concerned about the suggestion that "targets of interest" may be over-represented by Democrats, journalists, women and people of color.

Answer:  Yes, I am deeply concerned about these reports.  Falsified law enforcement reporting has anti-democratic objectives, but patterns of "targeting" and the presence of "lists" of law-abiding Americans intended to facilitate that "targeting" imply political objectives of active harm that need to be closely examined.

It's important to state that law-abiding Republicans have found their way onto the "target of interest" list, too.

Anyone who obstructs the efforts of far right FBI personnel to exert social and economic control over the American electorate is threatened with having their lives "ruined" by being placed on this "list."

So, all Americans need to be concerned about the actions of far right FBI Counterintelligence personnel as  manifesting fundamentally undemocratic and unconstitutional harms toward the law-abiding American public.

4.  In reading Milton Mayer's book, They Thought They Were Free, you see some similarities between the far right of Germany in the 1930's and 1940's and the far right as it is manifesting in the United States today.

Answer:  They are twin movements.  Both of them emerged from segments of the population that felt economically pressured and aggrieved.  Unfortunately, great harms can emerge within populist movements that nurture a certain type of anger.  When "lists" of scapegoats are being compiled -- citizens who are being falsely accused of wrongdoing -- human atrocities become possible.

5.  Yet, human atrocities tend to be hidden from the general population.

Answer:  They do.  Perpetrators of these wrongs understand that such predation will never be broadly accepted or condoned.  So, they conceal them with euphemistic program titles such as the Nationwide Suspicious Activity Reporting Initiative.  The public is intentionally misled by language such as this.

6.  How do you answer the observation that law enforcement officers work in a dangerous profession that requires immense dedication?

Answer:  I think that's absolutely true.  My sense is that we need to bring heightened transparency and accountability to law enforcement reporting and the legal actions that follow from that reporting.  And after that, we need to ensure that law enforcement officers are paid enough that they can refuse bribes and payoffs without worry for their families' well-being.

7.  You feel that law-enforcement officers should be paid more, but held to high standards which prevent corruption from taking hold.

Answer:  I do.  I think we need to recognize the perils present in the fact that many law enforcement officers maintain cryptocurrency accounts.  Deposits into those accounts cannot be easily traced, and we never want that lack of transparency to be present when it comes to law enforcement personnel.

8.  You also believe that civilian review boards should be actively engaged with law enforcement organizations in their communities.

Answer:  Yes, but I think civilian review boards need to have substantive legal authority over law enforcement agencies.  In other words, the public, in the form of the civilian review board, should remain the employer of the law enforcement entity.

Infragard payments to police departments, sheriff's offices and their personnel should be disallowed, in my opinion.

9.  Why?

Answer:  It is my understanding that Infragard payments have been extended to local law enforcement personnel who have engaged in knowingly falsified reporting as part of NSARI and the FBI's "target of interest" program.

Those incentives need to be halted.

10.  What about a civilian review board to address federal law enforcement agencies?

Answer:  I believe this should be a high priority.  

11.  What is the remedy for growing totalitarian influences within a society?

Answer:  The remedy is the spoken truth.  If the American public is allowed to understand that there are those on the far right who have intentionally fanned the flames of division and hatred within our country -- then I think a new dedication to democracy becomes possible.

Sources of propaganda need to be actively addressed, because their influence is profound.

Fundamentally, democracy requires that we extend compassion and goodwill, ethics and generosity toward one another.

President Biden personifies these qualities, in my opinion, so he is the ideal Commander-in-Chief for this moment in our history.  We are most fortunate in this gift.  It is the fact of his character and integrity that affords democracy a chance.

12.  You love the fact that President Biden grew up in a white clapboard house in Scranton, Pennsylvania. 

Answer:  I do.  President Biden is able to extend immense compassion to the American electorate, partly because he was not raised in a circumstance of extreme privilege that would have otherwise isolated him.  The love within his family gifted him with wisdom, integrity, empathy, judgement and leadership -- not a trust fund.  

And I think he presents a shining example of a uniquely American inheritance, in which the wealth of his family accrued within his character, not within his bank account.

He has the ability to listen to the whistleblower, the outsider -- even when others may be trying to silence that voice of concern.

And so, he possesses a capacity for defending our democracy that I believe is rare.

13.  You believe his leadership is central to America's opportunity to illuminate the Constitutional violations of the far right.

Answer:  Yes, I do. President Biden is not replaceable in leading us through these shoals.  His courage is equal to this task.  But that is a rare gift, and I hope the American electorate can come to understand why.

Rachel Maddow on the Arrest of a Former FBI Counterintelligence Official

1. Did you see Rachel Maddow's interview on MSNBC with Mary McCord, former top national security official at the U.S. DOJ?

Answer:  I did.  This involved the arrest of a former top FBI Counterintelligence official for money laundering for Russian oligarchs.

2.  What were your impressions?

Answer:  I was extremely pleased to see this development, and all praise goes to Rachel Maddow for asking some of the difficult questions relating to Russian infiltration of the far right within the FBI.  The investigators involved in this arrest are to be celebrated.

3.  What questions would you have added to Rachel Maddow's dialogue if you could?

Answer:  Is it reasonable to assume that money laundering activities for Russian interests were limited to a single former FBI Counterintelligence official?  Is it possible that the FBI elected to cast the blame on a lone former intelligence official rather than address more widespread problems of Russian infiltration of the national security apparatus as represented by far right personnel within the FBI?

4.  You think the problem of Russian infiltration of the far right has manifested in FBI Counterintelligence in a more systemic way.

Answer:  I do.

5.  Why is this your belief?

Answer:  Primarily because my stalker, who is reported to be a leading member of Russian-affiliated organized crime within the Untied States, appears to exert as much control over the FBI as Christopher Wray does, if not more.  In the past, he described Counterintelligence within the FBI as a "den of vice."  His words.  He appeared to refer to extensive involvement in this division with human trafficking and drug trafficking activities within the U.S.

6.  Did he appear to suggest that many agents were being paid off?

Answer:  "Who will pay the ferryman?" was his frequent refrain.  He seemed to be stating that payoffs to law enforcement, both local and federal, were the routine "cost of doing business" from the perspective of Russian-affiliated organized crime.

7.  What else struck you about the Rachel Maddow interview?

Answer:  Mary McCord at one point stated that her colleagues within FBI Counterintelligence were not typically pursuing investigations that led to charges.  They were, instead, simply "keeping America safe" with their ongoing investigations.  I found that commentary fairly heartbreaking.

8.  Why?

Answer:  Endless surveillance and interminable investigations of "targets of interest" likely represent falsified law enforcement reporting by FBI Counterintelligence personnel that cannot, as of this writing, result in charges against the innocent.

A Quora poster wrote this recently:

For years the FBI has been bloated, and needs busy work to line their files with to justify their existence and budgets.  Therefore, the fusion centers and Infragard create false "suspects" from the 2.5 million people on the main core terrorist watchlist, and proceed to perform intensive gangstalking on them, disguising it as "community policing."

That account sounds fairly accurate, though I suspect total numbers of Americans being actively surveilled by the FBI and affiliates well exceeds 2. 5 million.

9.  Why do you say that falsifications cannot likely result in charges of the innocent "as of this writing"?

Answer:  It's necessary to understand that falsified law enforcement reporting on this broad scale is goal-directed.  This is not merely "busy work" for an over-funded agency.  Falsified law enforcement reporting is, I believe, certainly intended to result in false charges at a future time.

We need to look at historical examples to understand the intention of those who engage in wide-scale falsified law enforcement reporting against law-abiding American citizens.  The Nazis defamed Jews as perpetrators of every crime imaginable for years before taking them forcibly from their homes.

Falsified law enforcement reporting has an objective, and it is not benevolent.

10.  When would far right factions of the FBI feel empowered to engage in mass arrests?

Answer: After a coup attempt such as that perpetrated on January 6, 2021, if the results of that insurrection had been different.  Try to recall that QAnon posters were predicting mass arrests if Trump had been re-elected.  https://www.businessinsider.com/qanon-trump-capitol-attack-belief-precursor-the-storm-2021-1. 

Where was all of the documentation to justify those threatened arrests of Democrats and journalists?  Who was aggregating it?  Who was creating it?

11.  You believe that far right factions within FBI Counterintelligence were doing so.

Answer:  I believe that to be the case, yes.  A portion of the falsified law enforcement reporting in which the FBI has engaged in my case may align with far right conspiracy theory.  Russia has used these precise stratagems to discredit its political opponents for years.  See paragraph number four of the following New York Times article:  https://www.nytimes.com/2020/04/27/world/europe/russia-historian-stalin-mass-graves.html   

So, it's alarming to see these methods appearing within FBI Counterintelligence, and it immediately raises questions for me about other degrees of compromise with regard to Russia.

12.  I am told that FBI Counterintelligence is now attempting to mischaracterize you and your husband as racist.

Answer:  First, according to criminal agents, I was delusional.  Then, according to criminal agents,  I was a predator toward children.  Next, according to criminal agents, I was a human trafficker.  After that, according to criminal agents. I was a drug dealer and manufacturer.  Eventually, according to criminal agents, I was a spy.  More recently, according to criminal agents, I was a tax evader.  Now, according to criminal agents, I am racist.

13.  How does it feel to be continually and willfully slandered in this manner?

Answer:  It feels like being the "target" of a group of predators without conscience, empathy or remorse.  But we need to expose the truth about the crimes of far right factions within the FBI or our democracy will founder.

14.  Can this group's crimes be halted before this insider threat to our democracy advances further?

Answer:  I believe they can.  

But one thing I will say is that my stalker has repeatedly referenced his view that he is engaged in a "race" to create disinformation in an effort to discredit me as an FBI whistleblower.    Counterintelligence and its affiliates need to stop creating fake allegations about my family while investigators have the freedom to pursue their fact-finding in the manner they determine most appropriate. Otherwise, far right segments of the FBI are controlling everyone with their constant stream of lies, threats, and invective.

15.  Your stalker calls his group within the FBI "shrewd thespians."

Answer:  Yes, and it's astonishing to understand that they see themselves as purveyors of disinformation.  Members of the far right know they're lying.  They simply feel entitled to get away with it.

16.  You are still awaiting materials responsive to your FOIA request.  What is the basis on which they have been withheld from you?

Answer:  I am entirely law abiding and so is my husband.  There is no basis on which the FBI can withhold these materials from me.

17.  And you desire these materials in their entirety.

Answer:  The materials in their entirety have been used as a knowingly false basis for the defamation of my character for years by far right FBI personnel.  I have a right to examine them in full.

18. You sound determined.

Answer:  Decidedly so.

The FBI is a deeply divided agency.  There are many FBI employees who view their vows to the Constitution with the utmost seriousness and honor, and who strive to defend the fundamentals of our democracy with courage, fortitude and commitment.  The fact that some segments of the FBI appear to have embraced a lawless course is not a justification to assail the FBI in general.  The safety of FBI agents should be protected, just as the safety of the American citizenry should be protected.  As President Joseph R. Biden has so rightly expressed, violence is never justified in any circumstance.  The rule of law must always be honored and upheld.  It is our shared determination to preserve the civil liberties and human rights of ALL AMERICANS that renders the United States a democracy.  We must never abandon this promise.  All of our most cherished freedoms depend upon it.

Update: Reflections on the Second Amendment by a "Target of Interest"

Update:  The response to questions #1 and #2 have been expanded.

1.  What is your feeling about the Second Amendment?

Answer:  Honestly, I am not in favor of firearms in private households without background checks and safeguards.  The vast majority of Americans support this reasoned, thoughtful approach to this matter.

2.  Why have you elected to lawfully possess a firearm within your own home?

Answer:  We have observed all lawful procedures, I need to emphasize.

My stalker has threatened to break into my home and cause violence to my family for a period of years in which we have appeared to be unprotected by law enforcement.  In fact, when we reached out to law enforcement for intervention in this situation, a corrupt sheriff's deputy engaged in falsified reporting concerning my complaint and made our situation immeasurably worse.

3.  Without going into all of the specifics, you felt that corrupt members of law enforcement were being compensated to write falsified reports connected to the Nationwide Suspicious Activity Reporting Initiative and the FBI's affiliated "target of interest" program.

Answer:  That is correct.

4.  Do you feel your lawful possession of a firearm within your own home has been protective under these extreme circumstances?

Answer:  I believe it has served as a disincentive to those who have wished us harm, yes.  But I also believe it has served as a means for far right segments of the FBI to discredit us as "dangerous" or a "security risk" or "deserving of surveillance," none of which is remotely true.

5.  Do you have evidence that people unknown to you have attempted to break into your home?

Answer:  I have heard the attempt of unknown trespassers to break into a first-floor window.  I have seen what appeared to be Special Forces personnel on the second-floor balcony of my home.  I have physical evidence of trespassers on the roof of my residence.  So, these signs are concerning, yes.

6.  Do you believe your lawful ownership of a firearm may have been used as justification for the deployment of Special Forces personnel to your residence in the past based on falsified law enforcement reporting about your family as perpetrated by far right segments of the FBI?

Answer:  I do.

7.  Would you ever take your firearm off of your property?

Answer:  Absolutely not.

8.  Why not?

Answer:  Because it is intended solely for the purpose of protecting our lives in a defensive manner within our own home and on our own property.  It has no other purpose whatsoever.

9.  Do you believe far right factions of the FBI have made false-flag accusations against your family, in falsely claiming that you are dangerous, therefore you need to be assailed by law enforcement personnel?

Answer:  Absolutely.  

And I will just gently remind everyone that Breonna Taylor was a victim of falsified law enforcement reporting before she was shot and killed within the boundaries of her own home.

Corrupt members of law enforcement had knowingly mischaracterized people at her residence as "dangerous," and as a result of that deceit, she lost her life.

It is necessary to understand that that loss of life was the intended result of the falsified law enforcement reporting perpetrated against her.  It was not an unanticipated or accidental outcome.

Falsified law enforcement reporting is designed to harm "targets of interest" within every aspect of its implementation.

The disinformation that is being wielded by the far right in the perpetration of falsified law enforcement reporting is not by happenstance.  It is by design.

10.  Your point is that totalitarianism depends upon its ability to wield disinformation to determine the fates of anyone and everyone.

Answer:  Yes.

11.  Are you a violent person?

Answer:  In no way, shape, or form.

12.  Yet, you feel your determination to defend yourself and your family has likely helped to protect your lives in this circumstance, in which you stand as a whistleblower of the FBI's corruption of the Nationwide Suspicious Activity Reporting Initiative and the agency's affiliated "target of interest" program.

Answer:  Our lives have primarily been protected by the intervention of those heroes within our federal government who support democracy.

But yes, I believe my determination to protect us within the bounds of our own home may have helped.

13.  What would serve as the greatest contribution to your safety and that of your family at this time?

Answer:  The fulfillment of my Freedom of Information Act request in its entirety.

OIG Hotline investigators, I am cognizant of the fact that my stalker appears to extend disinformation to me quite readily.  I regret that I am unable to distinguish which information represents a serious threat from which information is intended to discredit my efforts.

Because I have witnessed what appear to be Special Forces personnel at my residence in the past, I am now inclined to report my stalker's threats on this blog, even when their likelihood appears low.

If it is true that my FOIA request will soon be fulfilled, as has been suggested, this development may explain the sudden increase in volume and specificity of threats to my family members and myself.

What do I genuinely believe about far right factions of the FBI?

I believe they're not accustomed to being caught.

I believe they have been involved in substantive crimes against the law-abiding American public.

I believe their response to mounting evidence of their malfeasance is not contrition, but redoubled aggression.

In the face of such unprovoked and unwarranted wrongdoing by the far right against the law-abiding American electorate, it is necessary to respond with calm, even in circumstances that manifest substantive threats to my family's safety and my own.

Please understand that I am constantly gauging the strength of response required when confronting a specific set of threats.

Certain posts addressing threats with a low degree of probability but a high degree of harm will appear on my blog temporarily before being removed.

For purposes of documentation, all blog posts are emailed to lanemacwilliams@gmail.com.  In the unanticipated event of my disappearance, disability or demise, emails -- even if deleted by a third party -- should be retrievable through a forensic process from my Gmail account.

As you know, I have attempted to ensure that my cell phones, computers, papers and recordings belong to the Office of the Inspector Hotline Investigations Division.

While I myself harbor abiding hopes of being able to articulate my experience in a manner that protects the civil liberties and human rights of the American electorate, it is my desire that, in any eventuality, the materials I have provided to the OIG Hotline Investigations Division should be utilized in defense of our democracy.

I wish to express once again my profound appreciation for the ongoing efforts of your investigators, without which I would not have been able to dedicate myself to this cause.

I am also deeply grateful for the efforts of the Honorable Avril Haines.

And I wish to state with humility how abundantly appreciative I am of our Commander-in-Chief.  President Joseph Robinette Biden represents democracy's brightest hope, in my opinion, both domestically and reaching to the farthest corners of the globe.

The American electorate needs to understand the reason why with as much clarity and immediacy as I do.

Democratic freedoms do not inhere within the aspirations of a fraction of our populace.  They live within the hopes of men and women everywhere.

It is not too far a reach to say that upon those hopes rests the future for all of us.

It continues to be my privilege to labor on behalf of that future.

And it continues to be my honor to do so in your company.

The FBI is a deeply divided agency.  There are many FBI employees who view their vows to the Constitution with the utmost seriousness and honor, and who strive to defend the fundamentals of our democracy with courage, fortitude and commitment.  The fact that some segments of the FBI appear to have embraced a lawless course is not a justification to assail the FBI in general.  The safety of FBI agents should be protected, just as the safety of the American citizenry should be protected.  As President Joseph R. Biden has so rightly expressed, violence is never justified in any circumstance.  The rule of law must always be honored and upheld.  It is our shared determination to preserve the civil liberties and human rights of ALL AMERICANS that renders the United States a democracy.  We must never abandon this promise.  All of our most cherished freedoms depend upon it.

Update: Documentation of Phone and Email Communications with CPA Andy Favor

OIG Hotline investigators, I am posting this email on my blog for the sole reason that I experienced extensive tampering with the first email communication listed here while I was attempting to send it to CPA Andy Favor.

It seems that Mr. Favor may be pressed into falsely reporting the FBI's directed attestation that "targets of interest" "make no logical sense."

Well-reasoned emails likely refute such claims in a manner that far right segments of the FBI find inconvenient.

Accordingly, thank you for allowing me to convey this communication to your Office.

Out of an abundance of caution, my phone conversations with Mr. Favor were audio recorded and can be made available to OIG Hotline investigators upon request.

Andy, thank you for our phone call this morning.

In combing through my recent mail, I see that all the mailings addressed to my father are labeled "Important Documents Enclosed," not "Important Tax Documents Enclosed."

If I do receive any 1099 relating to my father's trust, I will reach out to you again.

I did not mention to you over the phone that I am currently serving as a whistleblower of FBI malfeasance with regard to the perpetration of knowingly falsified law enforcement reporting against law-abiding American citizens.  Both the Nationwide Suspicious Activity Reporting Initiative and the FBI's affiliated "target of interest" program appear to have been broadly corrupted by far right segments of the agency.  Because these programs draw billions of dollars in congressional budget appropriations every year, this issue is of critical interest to many.

Among the many threats I have received personally is the threat of a special category of IRS audit.

As a result, I am endeavoring to ensure to an even greater extent than usual this year that I am paying all of the federal and state taxes I could possibly owe.

As I mentioned, my brother's failure to claim all of his inheritance from my father has been a challenging matter.  I, as Trustee and Executor of my father's estate, was not able to claim my brother's funds on his behalf, in the absence of legal incapacity on his part.

A complex situation, to be sure.

As I mentioned, I do anticipate that those funds will be returned to the state, and I have notified my brother of that anticipated transfer.

At any rate Andy, it was lovely to catch up with you briefly over the phone this morning.

You were a wonderful help to me as I cared for my father, and I want to thank you for extending your thoughtful and honest expertise through those years.

There is a new 10 year rule that only applies after 2019.  And there are new rules for the penalty that go into effect for 2023.

But I think he may have a 50% penalty on what should have been taken in the past.

From the IRS:

Owner Died On or After Required Beginning Date If the owner died on or after his or her required beginning date (defined earlier), and you are the designated beneficiary, you must base required minimum distributions for years after the year of the owner's death on the longer of: Your single life expectancy shown on Table I in Appendix B as determined under Beneficiary an individual, later, or The owner's life expectancy as determined under Death on or after required beginning date, under Beneficiary not an individual, later.

The IRS was good at giving grace.  So he will want to get on this.

One of the stiffest penalties in the tax code is the one for not taking the correct RMD from an IRA or other qualified retirement plan.  You pay a whopping 50% of the amount that was supposed to be distributed but wasn't, a penalty known ass the "excess accumulations tax."  This penalty is in addition to paying income taxes on the distribution.

Andy, thank you for letting me know.  I will send this information to my brother.

In the interests of clarity, please be aware that my comments to you over the phone concerning financial predation toward my father on the part of my brother were based on two caregivers' accounts of bullying behaviors on my brother's part, in addition to my father's own expressed fears.

These dynamics can occur within families, but it's necessary to protect the independence, agency, and rights of the elderly when they do.
